CUSTOMER OBLIGATIONS

When you are purchasing products in our online shop, you confirm the following:

You are over 18 years old and are not registered blind or partially sighted
A suitably qualified person provided you with a valid written prescription for your glasses within the last 24 months, or – in case you are over 70 years old – in the last 12 months;
You entered all prescription details correctly; and
When requested you will supply your current prescription.
To ensure and protect the health of your eyes we strongly recommend regular eye checks by a qualified person. We are not responsible for any incident that occurs due to any deviation from your prescription.

VALIDITY OF THE GENERAL CONDITIONS

All our offers, products and services are based exclusively on the following General Terms and Conditions, even when accessed from outside UK. Terms and Conditions that deviate from or are contrary to these General Terms and Conditions will not be recognised by the seller and shall not apply. Customer’s terms and conditions that conflict with or differ from these conditions, are not valid unless we have expressly agreed to them in writing. Payment is made by you using either direct payment by credit card, Sage Pay or through other payment method we accepted. We are not obligated to accept the payment and if we decline payment the contract is automatically nullified.

THE CONTRACT BETWEEN US

For a contract to exist between us and the customer, we must receive full payment on the order. Our acceptance of payment of your order brings into existence a legally binding contract between us.
Payment is made by you using either direct payment by credit card, Sage Pay or through other payment method we accepted. We are not obligated to accept the payment and if we decline payment the contract is automatically nullified.
All products displayed on Uniglasses.com (the ‘website’) by the seller –including prices quoted– are non-binding and subject to change. All prices quoted contain the statutory VAT (value added tax) and other price components including standard delivery charges and postage. Any customers who are obliged to pay UK VAT in GB Pound Sterling and not in any other currency.
We are permitted and retain the right to make mistakes, such as typing errors, technical or color deviations, or price modifications, in spite of our greatest care not to do so. We also assume no liability whatsoever as to the accuracy of the manufacturer’s description.
You agree that you will receive invoices exclusively in electronic form.
If the contract between us has come into effect, but we cannot deliver the ordered articles within the foreseeable future, then we reserve the right to withdraw from the contract. If we should establish that delivery of goods may be delayed for an unforeseeable amount of time, we will appraise you of this fact and refund any payments already made by you.

DELIVERY, SHIPPING AND PASSING OF RISK

All UK orders are sent through Royal mail. All international orders are sent via international signed for delivery. All orders will require a signature. If an item is delivered to you and has been damaged in transit, we must be notified within one hours of delivery so we can claim this with courier service. Upon delivery of your order you will become the owner of the goods, they will be held at your own risk and we cannot be held liable for their loss or destruction.
Goods will be sent to the delivery address as provided on your order. For any amendments to the delivery address, we must be notified via email prior to the processing of your order. It is essential that you ensure you give a delivery address where the recipient will be available to accept the goods, or you must be prepared to collect the goods from your post office or the delivery services office following attempted delivery.
If we receive your order by 3pm (GMT/BST) during working days, we can arrange the delivery within the same day. If it is dispatched the following day, please allow an extra day for delivery. If the order is placed during the weekend, it will be delivered on next Monday.
We aim for delivery of all UK orders within one to three working days, but delivery may take longer in exceptional circumstances. For UK deliveries goods cannot be classified as missing in the post until fifteen working days have passed since the day of posting. We cannot take any action during this period, but will immediately make enquiries and re-send orders if delivery has not been made following the 15 working day period.
International delivery times vary, most of orders will take 1-2 weeks to arrive. but can take up to 28 days due to delays at customs. Most orders require a signature. If 28 days or more have passed and your order has not been received, please contact us to inform them of the delay. We would then have to launch an international track and enquiry, and as soon as we have the results we could resend or refund accordingly.
All Import Duties and Taxes are the responsibility of the customer. Duties will be assessed by the importing country based on current laws governing imports.
We cannot be held responsible for failed deliveries, either due to an incorrect address or unavailability of a signature on delivery. If goods are returned to us for these reasons we can re-charge for postage and handling, or deduct the shipping costs from the purchase cost if a refund is requested.

RETURN AND REPLACEMENT

Under the United Kingdom’s Distance Selling Regulations you have the right to cancel your order for any non bespoke item purchased from Uniglasses for a full refund if the product is in good condition without influencing further selling.
Order cancellations must be made in writing, quoting your order number to our customer service, within 14 days of the day after you receive the goods. If however your order has already been dispatched, you will need to return the order to us.
Lenses cannot be returned since it is personal tailored product. any returns delivery fee will not be covered by UniGlasses. Gift wrap costs are non-refundable.
Once we receive the returned product and check the product is in good condition, we will immediately process your refunds. This usually takes around 5 working days.
If the item you received is faulty, you must contact our customer service in writing within 7 days of receiving the product, and then our customer service will tell you how to proceed with the return.
Once we receive the returned faulty product and we are sure the default is from manufacture defects instead of normal wear, tear or any accidental damage, we will start to process your requirement. It will take around 5 working days for us to deliver a new product for you.
If the item you received is not what you originally ordered, please get in touch with our customer service quoting your order number. We will then advise on how to proceed with the replacement.

WARRANTY

All sunglasses and glasses frames are covered by a 6-month warranty from the day of delivery. This covers faults from manufacturing defects and does not cover normal wear and tear or accidental damage. Sunglasses and glasses lenses are covered against manufacturing defects and not against scratches.
Should the delivered merchandise be defective or its warranted qualities flawed, or should it develop defects within the warranty period as a result of poor materials or faulty manufacturing, then we will either repair the items or provide you with a replacement. We reserve the right to refuse your choice of subsequent fulfillment if it entails disproportionately high costs.
All claims must be made in writing (email, fax or letter) and any defects communicated to us without delay as soon as they become apparent.
Upon discovery of any obvious deficiencies, and in order to prevent any further deterioration of the product, you are obliged to inform us immediately. Defective product must be returned to us for inspection in the same condition at the time that it was discovered as being faulty.

PRIVACY AND GOVERNING LAW

You acknowledge and agree to be bound by the terms of our privacy policy.
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

DISCLAIMER AND LIMITATIONS OF LIABILITY

We are exempt from being held liable for minor negligent breaches of duty, as long as they do not result in death or personal injury, or any breach of the statutory implied terms as to title of goods or claims according to the Product Liability Act. Furthermore, legal liability for breach of duties, which enables us to fulfill this agreement in the first place and in which the customer is entitled to trust, remains unaffected. The same applies to any breaches of duty by our vicarious agents.
We do not supply spectacles with single vision lenses of a spherical power greater than +9.50 and -9.50 (dioptres) and a cylindrical power greater than +4.00 and -4.00 (dioptres) – please do not request us to do this.
Uniglasses Ltd does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members agents directors or employees or for any fraudulent misrepresentation.
To the fullest extent permitted by law and save as provided above, neither Uniglasses Ltd nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Uniglasses Ltd or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
“The limitations of liability in these conditions shall apply equally for the benefit of Uniglasses Limited and any other associated company of Uniglasses Ltd as if references to Uniglasses Ltd included references to each such associated company.”
While Uniglasses Ltd uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Uniglasses Limited will not be responsible for any errors or omissions or for the results arising from the use of such information.
While Uniglasses Limited takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.
Uniglasses Limited will not be responsible nor liable for your use of any other websites which you may access via links within this website. Uniglasses Limited does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Uniglasses Limited.
The entire liability of Uniglasses Limited under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.
Uniglasses Limited will not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.
Uniglasses Limited may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Uniglasses Limited.
No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts ( Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

All rights reserved. The copying, modification, distribution, reproduction, or incorporation into any other work of part or all of the material available on this website in any form is prohibited. You agree not to use these marks or any marks which are similar without the written permission of Uniglasses Limited.

PAYMENT AND TAXES

We accept online payment in a secure environment through Sage or vouchers given by our website. Currently customers can pay their bill using a credit card or debit card. All transactions are shown in £ sterling.
We do not store personal or financial information in the process of payment, not do we share this information with 3rd parties.
All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being sent to a member state of the EC then the selling price will include VAT at the current rate. The current rate of VAT is 20.0%. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.
